Endoscopy Auckland is committed to safeguarding the privacy of personal information. We have a legal obligation to comply with the requirements of the Privacy Act 2020 and the Health Information Privacy Code 2020. Endoscopy Auckland's purpose is to enhance the health, recovery and wellbeing of New Zealanders. To achieve this, we need to collect, use and share information about people receiving our services.
We collect your name, date of birth, NHI (if available), address, and contact details to identify and reach you as needed. We also gather health information relevant to your care, including current symptoms and medical history, and we gather information relevant to how your treatments will be funded. We aim to collect only what is necessary for our lawful purposes.
Whenever it is practical to do so, we will collect your information directly from you. This may take place when you complete admission or administration paperwork via the admission process, through your doctor's rooms, or over the telephone.
Sometimes we may need to collect information from third parties such as a whānau member, power of attorney, your insurance provider, or another health service provider if it is unreasonable or impractical to collect it from you. For more details on what personal and health information we collect about you from others, how we use that information, and where we share that information, please see the "indirectly collected information" section of this privacy statement.
We collect personal and health information from people who use our services to deliver appropriate medical care and advice. In addition, we obtain personal information from medical practitioners so we can enable them to work at our hospital.

On the day of your procedure and until you are able to receive phone calls, our reception or nursing staff will provide callers with a general statement about your health, unless advised otherwise. If you do not wish to have any information disclosed including your presence at our facility, please discuss this at the time of admission.
We may share your information with other healthcare professionals and agencies involved in your care and treatment. It is normal practice to give necessary and relevant information about you to:
In order to provide you with medical care, arrange your appointments (where these are administered by Endoscopy Auckland), and, if applicable to your treatment and funding type, arrange for funding pre-approval with your insurance provider or a different funding entity (such as ACC or Health New Zealand | Te Whatu Ora), we need to collect certain types of information about you from others and use and disclose that information as set out below. If we do not collect this information, we will not be able to contact you or provide you with appropriate medical care.
Before you can book in an appointment with one of our specialists at Endoscopy Auckland, our doctors and staff will review your referral and may access additional health information from your referrer and your medical file, as well as biographic information (such as your age, gender, and ethnicity), your NHI number, and contact details for you and your emergency contact or next of kin.
We collect this information from your referrer, the referral itself, and if we need more details, we collect the additional health information from your medical records held by the public hospital system and your other medical care providers. We may also need to collect your personal and health information from whānau.
We use this information to assess your request for an appointment, to contact you to arrange your appointment, and to enable our doctors and clinical staff to prepare for your appointment and provide you with appropriate medical care. If you are booked in for surgery, endoscopy or other treatments at one of our Endoscopy Auckland facilities this information will also be provided to the hospital and your medical team there.
If your referral contains information about your insurance provider or any another entity that is funding your treatment, or if we are otherwise provided this information, we will provide funders with all necessary information so we can confirm if that entity will fund your appointment, surgery, endoscopy or other treatment at our Endoscopy Auckland facilities and the extent of any shortfall required before your appointment or procedure. The information we provide funders includes:
If you require surgery or an endoscopy procedure at one of our Endoscopy Auckland facilities, we may also need to collect personal information about you from others so we can provide you with the best possible procedural and post-procedural care. Where we do so, this may involve accessing your medical file held by the public hospital system or another hospital, contacting your referrer or other health providers for additional health information, or requesting details from your whānau.
As part of preparing for your surgery or endoscopy procedure, you may need to undergo certain pre-procedure tests (which your specialist will discuss with you). The results of these tests and the information we collected as part of your appointment with our specialists may need to be reviewed by your medical team (including as relevant the surgeons, endoscopists, anaesthetists, and nurses) before you can be admitted to our facilities. You may be contacted by members of your medical team to discuss the results before your surgery.
Post-surgery or endoscopy procedure, we will share your discharge information with you and your referrer, and with other medical professionals involved in your care as applicable and discussed with you.
In the event of complications or for quality assurance purposes, we may also need to share your personal and health information (which we have collected from others about you or from you directly) with the public or other hospital system and other medical professionals involved in your care. We may also access your medical records held on the public hospital system or other hospital as part of your post-operative care or for quality assurance purposes.
You have the right to request access to personal information we hold about you (including medical records) and to request corrections. Please submit requests in writing to Endoscopy Auckland. We may require you to provide proof of identification. There is no charge for access to your medical records. You can download a Request for patient records here.
In limited circumstances where we may decline access, (such as where giving access would put your health or the privacy or safety of another person at risk); we will explain the reason in writing.
We retain personal and health information only for as long as it is necessary for our lawful purposes and to meet applicable legal, regulatory, and clinical obligations.
Patient records are retained for no less than 10 years after the most recent date which an individual was provided services.
If we experience a privacy breach that has caused or is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and affected individuals as soon as practicable, consistent with the Privacy Act. We will also take steps to contain, assess and remediate the breach.
